A long running dispute between two companies over brewing equipment assets was back before the Supreme Court of NSW this week.

Icon Brewing filed a summons in August 2017 seeking that its former packaging partner Boka Beverages be restrained from selling or dealing in any way with Icon’s brewing equipment.

Icon and Boka met in court on Wednesday March 14 for a directions hearing relating to the equipment matter, which is separate to the contractual dispute between the parties, for which judgment is still pending.

Icon alleges in a Statement of Claim dated October 2017 that its representatives attended Boka’s premises last August to inspect the equipment and found that a Keg Boy keg washer and filler was missing, as were laboratory equipment and a filtration unit.

The company is seeking “damages for the detention of/conversion of the equipment” from Boka, and costs.

Boka’s defence
Boka denies that it removed the abovementioned equipment in its defence filed in February 2018.

Boka claims it has “claimed a debt due to it” that is the subject of its separate contractual dispute with Icon Brewing.

“To the extent that such debt is determined to be due and payable by [Icon to Boka], such amount is raised as a set-off against any claim against [Icon] found to be due and payable in these proceedings,” Boka’s defence says.
